Senate Bill 10
Some of the provisions of the newly enacted Adam Walsh legislation, Senate Bill 10, went into effect on July 1, 2007: 2950.031, 2950.032, 2950.033, 2950.042, 2950.043, 2950.131, and 5321.051.
Of special note, NEW 2950.032: If on or after July, 1 2007, and prior to January 1, 2008 an offender or delinquent is convicted of or pleads guilty to a specified offense and the court does not sentence the offender or delinquent child to a prison term the court shall do the following:
Under 2950.32 (C):
- Provide the offender or the delinquent child and the delinquent child's parents with the notices required under § 2950.03 as it exists prior to January 1, 2008, regarding the offenders duties.
- Provide the offender or delinquent child and the delinquent child's parents with notice that contains information described above, regarding the changes to Chapter 2950 and the changes to the offender's or delinquent child's duties.
- Provide the offender or delinquent child with notice that they must comply with the dues as they are under current law and that they will be required to comply with the duties as changed on January 1, 2008.
Under (D) REQUIRE OFFENDERS OR DELINQUENT CHILD SIGN A FORM THT THEIR NEW DUTIES HAVE BEEN EXPLAINED TO THEM. NO FORM HAS BEEN CREATED TO MEET THIS PURPOSE YET.
